Foreign Relations Committee maintains a workshop on (legal proceedings legislative Bsiralajraouat treaties and international conventions, bilateral and multilateral)

It established the Foreign Relations Committee and sponsored by the board of the Presidency of the Council of Representatives and a workshop on Wednesday, 08/03/2017 at the Constitutional Hall in the House of Representatives, under the title (for legal proceedings legislative Bsiralajraouat treaties and international conventions, bilateral and multilateral, based on the rules of procedure of the House of Representatives and the Law of Treaties held No. 35 for the year 2015).

The workshop was attended by the President of the Legal Department of the General Secretariat of the Council of Ministers and advisers in the State Consultative Council and the heads of Aldoairaleghanonah in all ministries and Aldoairalakhary relevant, as well as the participation of the House of Representatives parliamentary adviser and the department in the Council.

And he opened MP Abdul Bari Zebari, head of the Foreign Relations Committee workshop speech, in which he welcomed the attendees, pointing to the importance of treaties as a source of international law and expressive explicit will of the state, stressing that the deal states is one of the necessities of life and continuity and that this will only be correct by law and the holding of treaties and conventions.
Zebari said that the treaty is a tool to achieve the kind of stability in international life, as the states when the contract designed to regulate certain issues in particular, expressed their interests.
He stressed Zebari said Treaties Act No. 35 of 2015 invites us all to adhere to the completion of the voting process and the ratification of the treaties and agreements are showing the expression of the will of the state in the ratification or accession based on the interest of our people to a high standard of legal responsibility and professional know-how.
The President expressed his hope to take advantage of this workshop through the exchange of information and dialogue to reach the optimal formula in a smooth functioning of the legislative procedure for the ratification of and accession to international treaties.

And it presented during the workshop, working papers, where Dr. Munif senses Shammari director of the Legal Department of the Presidency and a working paper on the role of the presidency and the stages of the ratification of international treaties and agreements and the most important problems and obstacles faced by the Presidency of the Republic in the ratification of these conventions and treaties.
Shammari also gave a presentation on the most important conventions and treaties that have been ratified by the President of the Republic.

For his part, Deputy Head of the Legal Department of the General Secretariat of the Council of Ministers and a working paper on the role of the Council of Ministers in the preparation of the draft ratification law or to join the international treaty and the difficulties faced by the Council of Ministers at the conclusion of or accession to international conventions and the need not to enter into treaties and conventions that make it burdensome Iraq the future, pointing to the existence of difficulties in the legal wording of these agreements.
He called for the need to display all the agreements and treaties concluded by ministries, agencies and provinces with international parties on the Council of Ministers before the conclusion of the audited and presented to the Council to stand on its items and materials to avoid get problematic in its application.

As Acanutorzhir Husseini gave adviser at the Investment Authority and a working paper on the conventions and treaties concluded by the provinces and ministries and departments not associated with the Ministry and its risks and the withdrawal of powers, including the conclusion of treaties and conventions.
And it puts forward the work of the representatives of the State Council and Ministry of Foreign Exchange and the Ministry of Justice.

The workshop discussed extensively threads holding ministries and provincial agencies and departments not associated with the Ministry of the conventions and treaties without taking the opinion or Cabinet advice and the difference between treaties and agreements and memorandums of understanding, the subject of non shackle government agreements and treaties where financial obligations and burdensome.

At the end of the workshop participants came out the following recommendations: -
1. the need to observe the formal and substantive requirements of the contract in accordance with the treaties, the treaties held No. 35 of 2015 Act.
2. find a general political department competent to draw foreign policies in holding international conventions and treaties linking the Secretariat General of the Council of Ministers or the formation of a competent political body.
3. The need to develop standards for the holding of memoranda of understanding in accordance with Article 3 of the treaty Contract Law No. 35 of 2015.
4. The need for the accession of the Republic of Iraq to the Vienna Convention on the Law of Treaties, a contract for 1969.
5. establishment of a competent legal training courses for cadres in the ministries concerned with the preparation of international conventions and treaties.
6. formation of a ministerial committee for political and artistic statement of opinion in the ratification and accession projects.
7. determine the powers of the provinces in the conclusion of memoranda of understanding and return to the General Secretariat of the Council of Ministers.
8. Work on the formation of a committee to look at the possibility of amending the treaties held No. 35 of 2015 Act.
9. prepare instructions for the implementation of the treaties contract law.
10. Adoption of all the observations and suggestions made by Messrs participants to study in the Foreign Relations Committee, and walk in the fundamentalist actions when agreed to by the rules of procedure of the Committee on Foreign Relations.
