[ltr]Baghdad - Mawazine News[/ltr]
[ltr]/ Mawazeen News / the text of the law of seizure and confiscation of movable and immovable property belonging to the pillars of the former regime voted by the House of Representatives during the parliamentary session today.[/ltr]
[ltr]The text of the law:[/ltr]
[ltr]Article (1) The movable and immovable property shall be confiscated and its revenues shall be recorded to the Ministry of Finance for:[/ltr]
[ltr]First: - Saddam Hussein Majid, former Baathist president, wives and children, his grandchildren and his second degree relatives and their agents who transferred the ownership of the funds referred to in this law and under their agencies.[/ltr]
[ltr]Second: The persons listed in the list attached to this law, which begin in sequence (1. Abdul Hamoud al-Tikriti) and end in sequence (52. Khamis al-Sarhan al-Mahmoud) and those who hold them in a party or official position illegally and by a court order, each of their wives and children and their relatives until the second degree And their agents who registered the money in their names.[/ltr]
[ltr]Third: - Subject to the provisions of the laws in force, for those mentioned in item (II) of this article and for all interested parties, who have legitimate money and did not get it because of taking office the right to object within one year from the date of entry into force of this law before a ministerial committee comprising representatives of the Secretariat The Council of Ministers, the Ministry of Justice and the Ministry of Finance shall not be less than (General Director) appointed for this purpose, and the victim of the decision of the Committee shall have the right to challenge its decision before the judiciary within 30 days for those who were inside Iraq and 60 days for those who are outside Iraq.[/ltr]
[ltr]Fourth: In the case of implementation of the provisions of confiscation before the entry into force of this law to sell the property sources or ownership by law, the objection to monetary compensation is limited.[/ltr]
[ltr]Fifth: - All the real estate acts on the properties confiscated pursuant to resolution (76) of 9/4/2003, which gave the state an obscene obscurity is not effective and return to the situation before the actions.[/ltr]
[ltr]Sixth: All real estate actions that have been booked in accordance with Resolution 88 of 9/4/2003 shall not be effective and shall be returned to the pre-disposition of such acts except for the residence referred to in Article 3 paragraph 1.[/ltr]
[ltr]Article 2 -[/ltr]
[ltr]First: - One house is exempted from an area of ​​400 meters and an increase of up to 600 meters. The payment of a financial allowance is paid at the current price of the family of any of those mentioned in item (2) of Article (1) and Article (1) of Article 3 of this law, , And benefit from the rule of this article the head of the family or his heirs.[/ltr]
[ltr]Second: - Forming a committee in the General Secretariat of the Council of Ministers to implement the provisions of Article (2) and determine its composition and mechanisms of work with instructions issued by the Council of Ministers.[/ltr]
[ltr]Article 3[/ltr]
[ltr]First: - Subject to the provisions of Article (2) of this law, movable and immovable property belonging to the Governors and whoever is a member of a branch and above in the dissolved Baath Party and whoever has the rank of Dean or equivalent (above) Investigative sections in the security services of the former regime (Intelligence Agency, Special Security, Intelligence System, Public Security) and Saddam Fedayeen.[/ltr]
[ltr]Second: - The person entitled to reserve under section (1) of this article shall request the lifting of the reservation signal before the Ministerial Committee formed under Article (III) of Article (1) of this Law within one year from the date of issue.[/ltr]
[ltr]Third: A two-year period shall be set for the dissolution of the subject from the date of submission of the application. Otherwise, the committee formed under Article III (1) shall be referred to an investigative committee set up by the Prime Minister.[/ltr]
[ltr]Fourth: The Court's decision to confiscate the money is based on a reality it has acquired during its period of official or party responsibility.[/ltr]
[ltr]Fifth: - The victim of the decision of the Committee the right to appeal its decision before the complainant within thirty days from the date of the decision.[/ltr]
[ltr]Article 4[/ltr]
[ltr]The provisions of Revolution Command Council Resolution No. 1198 of 2/11/1977 and its amendment No. 1426 of 21/12/1983 shall not apply to the decisions of the Revolutionary Command Council dissolved under the provisions of Articles 1 and 3 of this Law.[/ltr]
[ltr]Article 5[/ltr]
[ltr]The Supreme National Commission for Accountability and Justice shall prepare detailed lists within ninety (90) days from the date of entry into force of this law. The names covered by Articles 1 and 3 of this law shall include those lists and shall be communicated to ministries and entities not affiliated with the Ministry.[/ltr]
[ltr]Article 6[/ltr]
[ltr]Governing Council Decision No. 76 of 28 October 2003 and 88 of 4 November 2003 shall be repealed.[/ltr]
[ltr]Article 7[/ltr]
[ltr]The Council of Ministers shall issue instructions to facilitate the implementation of the provisions of this Law.[/ltr]
[ltr]Article 8 -[/ltr]
[ltr]This law shall be implemented from the date of its publication in the Official Gazette.[/ltr]
[ltr]Positive reasons[/ltr]
[ltr]After a bitter era of injustice and tyranny and violations that affected the Iraqi people to confiscate their rights and freedoms and to overcome the property and the theft of wealth and wealth, and in the course of democratic transformation witnessed by the country, and to achieve transitional justice by the laws and laws and identify the people covered by those laws, and to remove the ambiguity of some paragraphs And the provisions of such legislation and the establishment of the appropriate mechanism appropriate to the procedures of seizure and confiscation of this law.[/ltr]
