The Presidency of the Republic clarifies the reasons for the ratification of Law 13 of the House of Representatives

The Presidency of the Republic issued a clarification on the approval of President of the Republic Fuad Masoum on the Law of the House of Representatives and its Formations No. (13) for the year 2018, as well as the Presidential Decree to refer the members of the Council for its third term on retirement, while Prime Minister Haider Al Abadi challenged the law, Financial implications.
The Presidency said in a statement received by al-Sabah: "The social networking sites and media sites circulated today, news of the ratification of the rule of President Fuad Masoum on the Law of the House of Representatives and its Formations No. (13) for the year 2018 as well as the issuance of the Republican decree to refer members of the Council for its third term on retirement "Noting that« the Republican decree above was issued on the basis of the provisions of Article (13 / I) of the law of the Council, which indicated (first - taking into account Article 8 of this law is transmitted by presidential decree the President and Vice-Presidents and members of the Council to retire) The Presidency of the Republic shall issue the decree in application of the provisions of the decree The Presidency added that «on the ratification of the law of the Council, on the fifth of March 2018, voted the House of Representatives for its third session on the draft law of the House of Representatives and its composition, which regulates the work of the members of the Council - the cases of the end of the prosecution - the functions of the Council - Formations and owners of the Council - the budget of the Council, To the Presidency for the purpose of ratification under the book of the General Secretariat of the House of Representatives No. 3087/9/1 on the 14 of March 2018 ».
"The law was presented to the President of the Republic, who in turn referred it to the Legal Department for review and scrutiny. After examining the law, it was found that there were many constitutional and legal violations that were included in its provisions, in addition to the principle of separation of powers, Between rights and duties. As a result, the President of the Republic returned the law to the Chamber of Deputies with a view to removing those violations which were mentioned in a detailed reading to the Council under the President's letter No. 719/5/1 of 25 March 2018.
The Presidency of the Republic, that «the law was returned to the presidency for the second time to request ratification under the book of the House of Representatives No. 5495/9/1 on the seventh of June 2018, based in their communications that there are no constitutional or legal irregularities in addition to the Council claims that there is no constitutional provision that "The President of the Republic has refrained from signing to include constitutional violations, but the law has been passed by the legal period and has been sent for publication accordingly."
The Presidency pointed out that it "has worked to address all legislation in which there are constitutional irregularities or a deviation or a legislative defect, and has always challenged the legislation before the competent court, but this procedure is still inadequate and insufficient", explaining that «in order not to issue legislation that Violate the Constitution and lead to damage to public money or prejudice to public rights and freedoms, the Presidency believes that its right to object to these legislation and prevent the issuance of and will take all the constitutional means to do so ».
For his part, said a statement of the Office of the Prime Minister Media, received by the morning, that «the Prime Minister rejected the law of the privileges of deputies, which was legislated by the Council in a vague and which the presidency of the Republic now». The statement added that «Abbadi confirmed the submission of an appeal because he did not get the approval of the government as it has financial implications».
