Exemption and appeal.. A legal expert reveals how to choose a replacement for the resigned Finance Minister
16th August, 2022The legal expert, Ali Al-Tamimi, explained how to choose the alternative to the resigned Finance Minister, Ali Al-Tamimi.
Al-Tamimi said in a statement received by Mawazine News, a copy of it, that "regarding the resignation of the Minister of Finance, we would like to clarify the following:
1. It is not a resignation, but rather a request for an exemption because the Council of Ministers has basically resigned. 121 for the year 2022.
2. The replacement will be appointed as an agency... until the formation of the next government.. The alternative could be the deputy minister.
3. There is no law in Iraq that determines the duration of appointments by proxy, so it is the appointment of an agency for special grades, in violation of Articles 61 fifth and 80 fifth of the constitution.
4. These appointments can be challenged by proxy before the constitutional or administrative courts, and the appeal is from all interested parties, in accordance with Article 93 III of the Constitution.
5. These positions are important and are related to the people and services, and choosing people is very important.

Who will succeed the Minister of Finance after his resignation?
08/16/2022 16:21:49The legal expert, Ali Al-Tamimi, suggested today, Tuesday, assigning the Undersecretary of the Ministry of Finance to the portfolio of the ministry to succeed the resigned Ali Abdul-Amir Allawi.
Al-Tamimi said, in a statement that {Euphrates News} received a copy of it, that: “What happened with Allawi is not a resignation, but rather a request for an exemption, because the Council of Ministers has resigned mainly because it is a caretaker in terms of Article 64 II of the Constitution and the decision of the Federal Supreme Court 121 of 2022.” He added, "The alternative will be appointed as an agency until the formation of the next government, and the alternative could be the deputy minister."
Al-Tamimi noted, “There is no law in Iraq that determines the duration of proxy appointments, for this is the appointment of an agency for special grades, in violation of Articles 61 fifth and 80 fifth of the constitution, and these appointments can be appealed by proxy before the constitutional or administrative judiciary, and the appeal is from everyone who has an interest in accordance with Article 93 third of the constitution.” Al-Tamimi concluded, "These positions are important and relate to the people and services, and choosing people is very important."
Today, Tuesday, Finance Minister Ali Allawi submitted his resignation from his position during the cabinet session. An informed source said in a press interview that "Finance Minister Ali Allawi submitted, during the cabinet session held today, his resignation from his position."
