The Ministry of Finance continues its preparations to activate the work of the Law Commission affected by the dictatorial regime

The Central Committee continued common problem in accordance with the provisions of Law No. (16) for the year 2010, and the judge to compensate those affected by the dictatorial regime, for the necessary preparations on the provision of the necessary supplies.

The Committee offered the necessary needs of staff and machinery and equipment during an extensive meeting held in the Office of the Assistant Secretary-General for the ministries and provinces Mr. Rahman Issa Hassan, who instructed provided to facilitate direct the work of the Committee.
The Commission also decided to issue an order for the formation of a special committee is working to amend the law mentioned above and add those not covered by the law, and some of them washed their orchards because of the policies of the former regime, and the development of mechanisms and controls central calculates the amount of compensation.
The committee includes representatives from the Legal Department in the General Secretariat of the Council of Ministers and the Ministry of Finance and Property Claims Commission, that the amendment is raised to the State Council for approval.
The Department of Public citizens and public relations, has approached the Ministry of Finance for the purpose of activating the work of the aforementioned Committee, and to create the right place to accomplish the transactions of citizens covered by the decision.

Summary:
For the purpose of compensating the Iraqi citizens who have suffered injustice due to confiscation or destruction or freezing or seizure of their property due to abusive practices by the former regime, initiated this law.
Behalf of the people
Presidential Council

Based on what passed the House in accordance with the provisions of sub-section (I) of Article (61) and the legal period set forth in paragraph (a) of sub-section (V) of Article (138) of the Constitution.
Issued the following law:
Article 1
This law aims to compensate affected citizens in their movable and immovable property by the practices of the former regime, the value of the funds belonging to them movable and immovable that were confiscated or destroyed, freezing or seizure of political, racial or sectarian non-alia Authority Act solution property disputes Real Estate (2) for the year 2006.

Article 2
Counted for the purpose of compensation stipulated in Article (1) of this law, the value of movable and immovable Iraqi dinar denominated gold at the time of the damage.

Article 3
First:
A - constitute a central committee in the Ministry of Finance is composed as follows:
1 - first class judge nominated by the Supreme Judicial Council president
2 - A representative of the Ministry of Finance the rank of director member
3 - A representative of the Ministry of Justice the rank of director member
4 - A representative of the Kurdistan Region and each region will be formed by the rank of director member
B - The Central Committee shall:
1 - To approve the compensation decisions issued by the Sub-Committees problem in the provinces or territories.
2 - Raising the decisions on compensation to the Ministry of Finance for the disbursement of the amount of compensation within a maximum period of (90) days from the date of receipt of the decision of compensation from the province or territory to the Committee.
Second: A - formed in each province or territory of a subcommittee composed as follows:
1 - second class judge nominated by the Supreme Judicial Council president
2 - A representative of the Ministry of Finance the rank of director member
3 - A representative of the Ministry of Justice the rank of director member
4 - A representative of the province or territory to the rank of director member
B - the Subcommittee:
1 - receipt of applications submitted to it after (60) days of the effective date of the law.
2 - Consideration of requests submitted to it and estimate the amount of compensation according to the circumstances of each case and its proceedings.
3 - Raising its awards to the Central Committee for approval no longer awards in effect only after ratification by the Central Committee.

Article 4
Appeal the decisions of the sub-committees and the central front of the Appeals Committee, which formed in the Ministry of Finance through (60) days from the date of issuance of the Commission's decision and the decision of the Appeals Committee prohibited.

Article 5
The amount of compensation will be disbursed to the victim or his heirs legitimate and in accordance with the Qassam legitimate.
Article 6
Determine the mechanism of action of central and sub-committees and how to issuance of the decisions and the mechanism of submission of applications and accessories with instructions issued by the Ministry of Finance.

Article 7
Include the provisions of this law of Iraqis have been affected from the date of 07/17/1968 to 20/3/2003.

Article 8
Does not work with any text violates this law.

Article 9
This law is implemented from the date of its publication in the Official Gazette.
