According to the text of the article, "61" of the constitution and within the door of the powers of the legislative authority to declare a state of emergency in the country, are made ​​with the approval of a majority of two-thirds of the members of the House of Representatives, which states:





(A) Approving the declaration of war and a state of emergency two-thirds majority, at the joint request of the President of the Republic, and the Prime Minister.



To declare a state of emergency for a period of thirty days, subject to extension, for approval each time.



C. The Prime Minister the necessary powers that enable him to manage the affairs of the country during the period of a declaration of war and state of emergency, and regulate these powers law, not inconsistent with the Constitution.



D prime minister presents to the Council of Representatives the measures taken and results, during the period of a declaration of war and state of emergency, within fifteen days from the date of completion.





According to the draft National Safety Law, which the government sent to parliament, beginning last April, as the draft law on the powers of the Commander in Chief of the armed forces in the event of an emergency declaration, which is obligatory objections wide, included the following:

The approval of the House of Representatives and the President of the Republic to declare a state of emergency within 24 hours, and give the right of Prime Minister extended exclusively.

Illustrates the text of the law that the prime minister the right to exercise in areas that included the state of emergency authority to impose restrictions on the movement of people in transition and the traffic and roaming in certain places, and the arrest of people suspected in the behavior of public order, and the imposition of house arrest on dangerous people, and the law gives to the Prime Minister the right to issue orders to inspect the places and people whoever they are, and bans entry in some places an absolute prohibition.

He adds that the law of the prime minister the right to impose restrictions on the freedom of the people at the meeting and break up meetings and gatherings by force, and the evacuation of some parties, and restrictions on travel outside the Republic of Iraq or to come to him.

As the text to give the right to the Prime Minister dimensions of foreigners from the Republic of Iraq and prevent them entry, and censorship of the means of publication such as newspapers, magazines, books, brochures, drawings and chips and optical audio before it is published or broadcast, seizure and confiscation and prevent publication or broadcast and lockouts printed.

And reveals the law also give the prime minister the right to monitor messages postal, telegraphic and all means of telecommunications, electronic and inspected and tuned, and the imposition of controls on essential commodities trading and pricing.


It should be noted here that the powers of the Commander in Chief of the Armed Forces that has been declared a state of emergency will remain unclear, especially since the project Qnon National Safety did not pass after the House of Representatives.
