Federal Court: We issued a final decision on articles 126 and 142 of the Constitution and by agreement
BAGHDAD (Reuters) - The Federal Supreme Court said on Monday that it had received a request to extrapolate articles 126 and 142 of the constitution, which discussed mechanisms for amending it, and issued a final decision on them and the agreement.
The court said in a statement that "the court, after scrutiny and deliberation found that article (142) of the Constitution began to circumstances that require the interest of the components of the main people in Iraqi society and by amending the provisions of the Constitution in accordance with the procedures and steps set in them," adding that " (142) of the Constitution provided for the exception of the provisions of Article (126) concerning the provisions of Article (126) of the Constitution. To amend the Constitution until the completion of the decision on the amendments provided In Article 142 ".
The statement added that "the exception provided by the fifth paragraph of Article (142) is a condition that has not been achieved, the provisions of Article (126) of the Constitution can not be applied and that the constitutional provision needs to take into account that requirement. He stressed that" the application of Article 126 of the Constitution when submitting a proposal Amendment of one or more of the articles of the Constitution shall not be until after deciding on the amendments recommended by the Committee provided for in paragraph (I) of Article (142) of the Constitution in accordance with the procedures laid down in this article. "
